Before we embark on this memorable journey, we want to remind you that there are some inherent risks associated with horses and horse-drawn carriage tours.
Horses are magnificent but sometimes unpredictable animals, and while we take every precaution to ensure your safety, it's important to understand and accept all risks involved in voluntarily participating in a horse-drawn carriage tour. By purchasing a ticket and choosing to ride with us, you and your party will be agreeing not to hold Old South Carriage Company liable for any injuries, damages, or other losses incurred. Below is a more in depth look into the terms of liability that you and your group are waiving. If you choose not to accept these terms and assume all risks involved, please contact us to cancel the tour and receive a full refund. IN CONSIDERATION OF the risk of injury that exists while participating in CARRIAGE TOURS (hereinafter the "Activity"); and
IN CONSIDERATION OF our desire to participate in said Activity and being given the right to participate in same;
WE HEREBY, for ourselves, our heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, "Releasors," "we" or "us"), knowingly and voluntarily waive any and all rights, claims, or causes of action of any kind arising out of our participation in the Activity; and
WE HEREBY release and forever discharge Old South Carriage Company, Inc, located at 14 Anson St, Charleston, South Carolina 29401, their affiliates, managers, members, agents, attorneys, staff, heirs, representatives, predecessors, successors, and assigns (collectively "Releasees"), from any physical or psychological injury that we may suffer as a direct result of our participation in the aforementioned Activity.
WE ARE VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND ARE PARTICIPATING IN THE ACTIVITY ENTIRELY AT OUR OWN RISK. WE ARE AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. WE UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM OUR OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S). NONETHELESS, WE ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO US, OF OUR PARTICIPATION IN THIS ACTIVITY.
WE FURTHER AGREE to indemnify, defend, and hold harmless the Releasees against any and all claims, suits, or actions of any kind whatsoever for liability, damages, compensation, or otherwise brought by us or anyone on our behalf, including attorney's fees and any related costs.
WE FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that we should require medical care or treatment, we authorize the provision of all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. We further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. We are aware and understand that we should carry our own health insurance.
IN CONSIDERATION OF the individual reading this waiver of liability form, it is their responsibility to inform all members of their group or party about the terms and conditions outlined above. All participants must be aware of and agree to these terms before engaging in the Activity.
I HEREBY acknowledge that it is the duty of myself to ensure that each member of my group understands and consents to the risks and liabilities associated with participating in the Activity. Should any member of the group or party not agree to these terms, they must refrain from participating in the Activity.
By purchasing tickets and participating in the Activity, each member of the group or party is deemed to have accepted these terms and conditions, and thus releases and forever discharges Old South Carriage Company, Inc and its affiliates from any and all claims as outlined in this release of liability conditions.
